On August 13th, the official website of the Ministry of Commerce issued an announcement on the initiation of the final review of the import of single-mode fiber anti-dumping measures originating in India. The announcement said that the Ministry of Commerce will conduct a final review of the anti-dumping measures applicable to imported single-mode fiber originating in India. According to the recommendation of the Ministry of Commerce, the Customs Tariff Commission of the State Council has decided to levy anti-dumping duties on imported single-mode optical fibers originating in India during the period of the final review of anti-dumping measures in accordance with the scope and tax rate announced by the Ministry of Commerce in Announcement No. 56 of 2014.

On June 3, 2019, the Ministry of Commerce received Changfei Optical Fiber Cable Co., Ltd., Jiangsu Hengtong Optical Fiber Technology Co., Ltd., Fiberhome Fujikura Optical Fiber Technology Co., Ltd., Zhongtian Technology Optical Fiber Co., Ltd., and Hangzhou Fortis Communication Technology Co., Ltd. The company, Jiangsu Farsheng Photonics Co., Ltd. and Chengdu Zhongzhu Optical Fiber Co., Ltd. represent the application for the final review of anti-dumping measures submitted by China’s single-mode optical fiber industry. The applicant argues that if the anti-dumping measures are terminated, the dumping of imported single-mode fiber originating in India may continue or reoccur, and damage to the Chinese industry may continue or reoccur, requesting the Ministry of Commerce to decide to maintain imports from India.  Anti-dumping measures implemented by single-mode fiber.

According to the relevant provisions of the “Anti-dumping Regulations of the People’s Republic of China”, the Ministry of Commerce’s qualifications for applicants, products under investigation and similar products in China, import of products under investigation during the implementation of anti-dumping measures, possibility of continued or recurrence of dumping, damage continued or  The possibility of recurrence and related evidence were reviewed. The available evidence indicates that the applicant is in compliance with the provisions of Articles 11, 13 and 17 of the Anti-Dumping Regulations of the People’s Republic of China on industrial and industrial representation, and is eligible to apply on behalf of the Chinese single-mode optical fiber industry.  The investigation authority believes that the applicant’s claim and the prima facie evidence submitted meet the requirements for the final review.

According to Article 48 of the Anti-Dumping Regulations of the People’s Republic of China, the Ministry of Commerce has decided to conduct a final review of the anti-dumping measures applicable to imported single-mode optical fibers originating in India from August 14, 2019.  According to the recommendation of the Ministry of Commerce, the Customs Tariff Commission of the State Council has decided to levy anti-dumping duties on imported single-mode optical fibers originating in India during the period of the final review of anti-dumping measures in accordance with the scope and tax rate announced by the Ministry of Commerce in Announcement No. 56 of 2014.

The dumping investigation period of this review is from April 1, 2018 to March 31, 2019, and the industrial damage investigation period is from January 1, 2015 to March 31, 2019. The scope of the review product is the product applicable to the original anti-dumping measures, which is consistent with the product range of the Ministry of Commerce’s Announcement No. 56 of 2014.
